Who designates documents as classified?
Former Assistant U.S. Attorney for the Southern District of New York, Andy McCarthy joins Trey to break down former President Donald Trump's second indictment, this time on federal charges in relation to his handling of classified information while out of office.
Andy explains that in order for a document to be considered classified, it must be designated as such by an intelligence agency or official who has the authority to do that under the executive order. He later differentiates each classification category and what we as spectators have learned about the government's ability to keep their documents under control.
