Watch this video at- https://youtu.be/b9pgh5EO6lw John Stossel Published on Feb 5, 2019 Parts of San Francisco resemble the poorest slums in the world -- even though the city is one of the richest in America. Encampments of street people are everywhere. Some pitch tents. Others defecate on the sidewalk. Some are mentally ill and harass people. John Stossel asks: "why does such a rich city have a huge problem with homelessness?" One reason in that the city fails to enforce even basic laws against bad behavior. The Daily Wire's Colton Haas filmed one woman who says: "Police don't do anything about it. They'll get somebody for drinking a beer but they'll walk right past people using a needle." Many crimes, from shoplifting to car break-ins, are often ignored in San Francisco. An average of 85 cars are broken into every day in the city. Yet police make arrests in less than 2 percent of car break-ins. Even some street people complain about the behavior of crazy and violent homeless people. "They run around and they shout at themselves ... They make it bad for people like us that hang out with a sign," one man who usually sleeps on the street told us. Since store owners can't rely on city cops to deal with the masses of homeless, some hire private police to patrol around their stores. Private police are effective, and there used to be hundreds. But then the city's police union complained, and now there are fewer than 10 left. Stossel notes that another reason for the city's homeless problem is that the city offers relatively generous benefits: free shelter, train tickets, and $70/month in cash. That's in addition to food stamps people can already get. San Francisco's politicians have promised to fix the homeless problem for decades. In 1982, then-mayor Dianne Feinstein bragged about creating "A thousands units right here in the Tenderloin" for the homeless. In 2002, mayor Willie Brown said "you gotta do something about it." In 2008, mayor Gavin Newsom said, "our combined efforts ... have already moved 6,860 human beings off the street." In 2018, San Francisco's mayor was still calling for more money. San Francisco also passed a big new tax on employers to raise money. But so far, the extra funding hasn't worked. The number of street people has grown most every year. One reason is that rents in San Francisco are the highest in the nation. Laura Foote is an activist who runs the non-profit "YIMBY" -- or "Yes In My Backyard." She tries to convince people to allow more housing. But even in liberal San Francisco, many people don't want that. "I would hate it. I would hate it," one woman told John Stossel. "I think it'd be really congested," said another. Developers complain the city severely limits them. "Let me build," says developer John Dennis. He spent years trying to get permission to replace a graffiti-covered, long-defunct meat-packing plant with nice new apartments. He eventually got permission to develop the new building will house 60 people, but it took 4 years. "And all that time, we're paying property taxes and we're paying for maintenance of the building," Dennis tells Stossel. "What's your next project in San Francisco?" Stossel asks. "No more projects in San Francisco," Dennis replies. "I'm done. I'll never do another project here." Stossel points out the hypocrisy of the situation: "People in San Francisco often claim to be all about helping the poor. Watch this video at- https://youtu.be/rHErCY2PZNU John Stossel Published on Jan 29, 2019 Sports stadiums get billions of dollars in taxpayer subsidies, including Mercedes-Benz Stadium, home to the Atlanta Falcons and the site of this year's Super Bowl. Costing $1.5-billion, it's one of the most expensive stadiums in America. The owner of Atlanta's football team, billionaire Arthur Blank, persuaded Atlanta officials to force taxpayers to pay for more than $700-million in subsidies for his stadium. John Stossel says he understands why politicians subsidize stadiums. "They like going to games, and like telling voters, 'I brought a team to our town!'" says Stossel. He also understands why billionaires take the money, "if politicians are giving money away, Blank's partners would consider him irresponsible not to take it." And when it comes to already-rich people getting poorer people to fund their stadiums, Atlanta is not unusual. The Oakland Raiders got $750-million of taxpayer money to move the Raiders to Las Vegas. "In the last two decades … taxpayers across the country have spent nearly $7-billion on [NFL] stadiums," according to a Huffington Post article. In fact "12 teams … actually turned a profit on stadium subsidies alone," according to a Fox News report. Politicians claim their subsidies are "an investment." They argue the economic benefits a stadium will bring a city outweigh the cost. Las Vegas Mayor Carolyn Goodman said, "It really is a benefit to us that really could spill over into something." Stossel says this "spill over is bunk." Numerous economic studies have shown that stadiums are a bad investment for taxpayers. One by George Mason University concludes, "Despite the many millions of dollars spent on professional sports, little or none of that money makes its way back to the taxpayers who subsidize professional sports teams." In fact "… sports teams may actually hurt economic growth." Economist J.C. Bradbury points out that while money spent at football games is the "seen benefit, the unseen cost is that those people would otherwise be spending their money elsewhere in the local communities. At the local bar there's one less bartender. There was one less waitress hired at another restaurant. A movie theater that had one less theater full." Or how it works? Or why America uses it to elect its presidents instead of just using a straight popular vote? Author, lawyer and Electoral College expert Tara Ross does, and she explains that to understand the Electoral College is to understand American democracy. Script: I want to talk you about the Electoral College and why it matters. Alright, I know this doesn't sound the like most sensational topic of the day, but, stay with me because, I promise you, it's one of the most important. To explain why requires a very brief civics review. The President and Vice President of the United States are not chosen by a nationwide, popular vote of the American people; rather, they are chosen by 538 electors. This process is spelled out in the United States Constitution. Why didn't the Founders just make it easy, and let the Presidential candidate with the most votes claim victory? Why did they create, and why do we continue to need, this Electoral College? The answer is critical to understanding not only the Electoral College, but also America. The Founders had no intention of creating a pure majority-rule democracy. They knew from careful study of history what most have forgotten today, or never learned: pure democracies do not work. They implode. Democracy has been colorfully described as two wolves and a lamb voting on what's for dinner. In a pure democracy, bare majorities can easily tyrannize the rest of a country. The Founders wanted to avoid this at all costs. This is why we have three branches of government -- Executive, Legislative and Judicial. It's why each state has two Senators no matter what its population, but also different numbers of Representatives based entirely on population. It's why it takes a supermajority in Congress and three-quarters of the states to change the Constitution. And, it's why we have the Electoral College. Here's how the Electoral College works. The Presidential election happens in two phases. The first phase is purely democratic. We hold 51 popular elections every presidential election year: one in each state and one in D.C. On Election Day in 2012, you may have thought you were voting for Barack Obama or Mitt Romney, but you were really voting for a slate of presidential electors. In Rhode Island, for example, if you voted for Barack Obama, you voted for the state's four Democratic electors; if you voted for Mitt Romney you were really voting for the state's four Republican electors. Part Two of the election is held in December. And it is this December election among the states' 538 electors, not the November election, which officially determines the identity of the next President. At least 270 votes are needed to win. Why is this so important? Because the system encourages coalition-building and national campaigning. In order to win, a candidate must have the support of many different types of voters, from various parts of the country. Winning only the South or the Midwest is not good enough. You cannot win 270 electoral votes if only one part of the country is supporting you. But if winning were only about getting the most votes, a candidate might concentrate all of his efforts in the biggest cities or the biggest states. Why would that candidate care about what people in West Virginia or Iowa or Montana think? But, you might ask, isn't the election really only about the so-called swing states? Actually, no. If nothing else, safe and swing states are constantly changing. California voted safely Republican as recently as 1988. Texas used to vote Democrat. Neither New Hampshire nor Virginia used to be swing states. It's called the National Popular Vote, and it would turn our presidential elections into a majority-rule affair. Would this be good or bad? Author, lawyer, and Electoral College expert Tara Ross explains. Script: In every presidential election, only one question matters: which candidate will get the 270 votes needed to win the Electoral College? Our Founders so deeply feared a tyranny of the majority that they rejected the idea of a direct vote for President. That's why they created the Electoral College. For more than two centuries it has encouraged coalition building, given a voice to both big and small states, and discouraged voter fraud. Unfortunately, there is now a well-financed, below-the-radar effort to do away with the Electoral College. It is called National Popular Vote or NPV, and it wants to do exactly what the Founders rejected: award the job of President to the person who gets the most votes nationally. Even if you agree with this goal, it's hard to agree with their method. Rather than amend the Constitution, which they have no chance of doing, NPV plans an end run around it. Here's what NPV does: it asks states to sign a contract to give their presidential electors to the winner of the national popular vote instead of the winner of the state's popular vote. What does that mean in practice? It means that if NPV had been in place in 2004, for example, when George W. Bush won the national vote, California's electoral votes would have gone to Bush, even though John Kerry won that state by 1.2 million votes! Can you imagine strongly Democratic California calmly awarding its electors to a Republican? Another problem with NPV's plan is that it robs states of their sovereignty. A key benefit of the Electoral College system is that it decentralizes control over the election. Currently, a presidential election is really 51 separate elections: one in each state and one in D.C. These 51 separate processes exist, side-by-side, in harmony. They do not -- and cannot -- interfere with each other. California's election code applies only to California and determines that state's electors. So a vote cast in Texas can never change the identity of a California elector. NPV would disrupt this careful balance. It would force all voters into one national election pool. Thus, a vote cast in Texas will always affect the outcome in California. And the existence of a different election code in Texas always has the potential to unfairly affect a voter in California. Why? Because state election codes can differ drastically. States have different rules about early voting, registering to vote, and qualifying for the ballot. They have different policies regarding felon voting. They have different triggers for recounts. Each and every one of these differences is an opportunity for someone, somewhere to file a lawsuit claiming unfair treatment. Why should a voter in New York get more or less time to early vote than a voter in Florida? Why should a hanging chad count in Florida, but not in Ohio? The list of possible complaints is endless. Many kids don’t have choice in where they go to school. The school choice movement is trying to give them that opportunity  Of course, having choice when it comes to what kids learn is important too. Many schools teach kids that capitalism hurts people. So John Stossel started a charity called Stossel in the Classroom. It offers teachers free videos that introduce kids to free market ideas. Students rarely hear about these ideas in school. Graduates from Queens Technical High School in New York City who watched the videos while they were in high school explained that the videos were different from what they were used to. "They really opened up my mind to think differently" said Xiomara Inga. Antonio Parada added the videos "changed the way that I viewed the world." Gabriel Miller was so inspired by videos about the founding of America, he decided to enlist in the National Guard. He explains, "We are taught that this country is horrible." But after watching the videos, "I felt ashamed for what I initially believed…[so] I wanted to give back." Diony Perez was inspired to open his own business, an auto leasing company called Familia Motor Group. "The Stossel videos helped me become more of an entrepreneur," Diony said. Other students explained that certain videos like "The Unintended Consequences …" and "The Evil Rich" stuck with them. Johann Astudillo learned about unintended consequences from a video about minimum wage, "minimum wage increase priced out young people from getting jobs into the market." Victoria Guerrero learned that most rich people get rich by providing some benefit to society. "If it wasn't for Steve Jobs ... our life would not be as easy as it is today." Stossel says he is glad his charity helps students understand free market ideas. The government shutdown is now longer than any in history. The media say it's a "crisis." The Washington Post talks talks about the "shutdown's pain." The New York Times says it's "just too much." John Stossel says: wait a second. Looking around America, everything seems pretty normal. Life goes on. Kids still play and learn, adults still work, stock prices have actually increased during the shutdown. It's hardly the end of the world. But he adds that the government shutdown is still a problem. For some 400,000 furloughed workers, and another 400,000 working without pay for now, the shutdown hurts. But while New York Times columnist Paul Krugman calls it "Trump's big libertarian experiment," Stossel notes that the shutdown is not libertarian. Government's rules are still in effect, and soon workers will be paid for not working. Stossel calls that an un-libertarian experiment. Libertarians want to permanently cut government, not shut down parts for a few weeks and then pay the workers anyway. There are lessons to be learned from the shutdown. Government stopped collecting trash and cleaning up public parks in DC, so volunteers stepped in to pick up trash. Without so much government, Stossel says, private citizens will often step in to do things government workers used to do. Stossel says the shutdown highlights where some government waste can be trimmed. Farmers don't get their "support" checks during the shutdown. But Stossel asks–why should they get checks at all? While the big subsidies go to grain and corn farmers, most fruit and vegetable farmers get no subsidies. They survive without them. Other farmers could, too. FDA inspection of food has stopped during the shutdown. Paul Krugman asks smugly, "does contaminated food smell like freedom?" But Stossel notes that the main reason food is safe isn't government. It's competition. Companies worry about their reputation. Just ask Chipotle, Stossel says. Their stock fell by more than half after food poisoning incidents at their stores; since then they have instituted far more food inspection than government requires. Most food producers already do that. Beef carcasses undergo hot steam rinses, and microbiological testing goes well beyond what government requires. Market competition protects us better than rule-bound government bureaucrats. Stossel says most of government could be done away with or privatized. Even airport security. TSA workers aren't getting paid. But some airports (San Francisco, Orlando, Kansas City, and 19 others) privatized security. Those workers are still getting paid. They also do a better job. A leaked TSA study found that the private security agents, in test runs, are much better at detecting weapons in bags than the TSA. A congressional report found they are also faster at processing passengers. Stossel says that while politicians bicker about $5.7 billion in wall funding (much less than 1 percent of the federal budget) what they really should worry about is that America's debt will soon reach $22 trillion because government squanders money on useless things. At union protests, government workers say "We are essential!" But based on the above, Stossel says: Give us a break. But Swedish historian Johan Norberg says, "Sweden is not socialist." Norberg hosts a documentary called "Sweden: Lessons for America?" in which he notes that in Sweden, "government doesn't own the means of production. To see that you have to go to Venezuela or Cuba or North Korea." John Stossel asks Norberg why so many Americans think Sweden is Socialist. Norberg answers, "we did have a period in the 1970s and 1980s when we had something that resembled socialism: a big government that taxed and spent heavily." But in his documentary, he explains that big government led to problems: "our economy was in crisis, inflation reached 10%, and for a brief period interest rates soared to 500 percent. At that point the Swedish population just said, 'Enough, we can't do this'" Norberg tells Stossel. Sweden cut public spending, privatized the national rail network, abolished certain government monopolies, eliminated inheritance taxes, sold state-owned businesses, and switched to a school voucher system. They also "lowered taxes and reformed the pension system," adds Norberg. So Stossel asks why we keep hearing "that Sweden is this socialist paradise." Norberg answers: "We do have a bigger welfare state than the U.S. and higher taxes than the U.S. But in other areas, when it comes to free markets, when it comes to competition, when it comes to free trade, Sweden is actually more free market." He's right, according to the Heritage Foundation's Economic Freedom Rankings. Sweden ranks higher than the U.S. Norberg also tells Stossel that Sweden's tax system may surprise Americans. "This is the dirty little secret … We don't take from the rich and give to the poor. We squeeze the poor, because rich people might leave." Even people who earn below average income pay up to 60% in taxes. Stossel asks: what lessons should Americans take from Sweden? "You can't turn your backs [on] the creation of wealth," warns Norberg. Watch the video at- https://youtu.be/8dnVZibrV6g PragerU Are there circumstances under which a murderer deserves the death penalty? In other words, should capital punishment be abolished or not? Dennis Prager explains. Script: There are almost no issues where I don’t understand both sides: taxation, the size of government, abortion, socialism, capitalism. As strongly as I feel about any issue, I understand the opposition. But there is an exception: the death penalty for murder. Here, the gulf is unbridgeable between those of us who believe that some murderers – and I emphasize some murderers – should be put to death and those who believe that no murderer should ever be put to death. Take this example: On the afternoon of July 23, 2007, in the town of Cheshire, Connecticut, two men broke into the home of Dr. William Petit, his wife Jennifer and his two daughters. The men beat Dr. Petit nearly to death with a baseball bat; one of the men raped the doctor’s wife; and the other man sexually assaulted their 11 year-old daughter, Michaela. The two men then strangled Mrs. Petit to death, tied down the two daughters on beds, doused them with gasoline, and, while the girls were still alive, set the house on fire. Dr. Petit survived, but his wife and daughters did not. Those opposed to capital punishment believe that these two men have a right to keep their lives. So, is there anything a person can do to deserve the death penalty? To those opposed to capital punishment, the answer is no. In fact, many opponents of capital punishment believe that killing murderers is the same as murder. You heard me right – most opponents equate the murder of an innocent family with putting the murderers of that family to death. Opponents of capital punishment also argue that keeping all murderers alive sanctifies the value of human life. But the opposite is true. Keeping every murderer alive cheapens human life because it belittles murder. That’s easily proven. Imagine that the punishment for murder were the same as the punishment for driving over the speed limit. Wouldn’t that belittle murder and thereby cheapen human life? Of course, it would. Society teaches how bad an action is by the punishment it metes out. And what about the pain inflicted on the loved ones of those murdered? For most people, their suffering is immeasurably increased knowing that the person who murdered their family member or friend – and who, in many cases, inflicted unimaginable terror on that person – is alive and being cared for. Of course, putting the murderer to death doesn’t bring back their loved one, but it sure does provide some sense of justice. That’s why Dr. Petit, a physician whose life is devoted to saving lives, wants the murderers of his wife and daughters put to death. In his words, death "is really the only true just punishment for certain heinous and depraved murders." Is the doctor wrong? Is he immoral? Well, if you think capital punishment is immoral, then Dr. Petit is immoral. And what about opponents’ argument that an innocent person may be executed? This argument may be sincerely held, but it’s not honest. Why? Because opponents of capital punishment oppose the death penalty even when there is absolute proof of the murderer’s guilt. Script: The promoters of identity politics—the idea that we are primarily defined by our race and gender—have taken over the humanities and social sciences. That’s bad. But not as bad as this: They are moving in on “STEM” – science, technology, engineering and math. “All across the country,” a UCLA scientist reports, “the big question is: how can we promote more women and minorities by ‘changing’ (i.e., lowering) the requirements we had previously set for graduate level study?” The National Science Foundation (NSF), a federal agency that funds university research, exemplifies this approach. Progress in science, the NSF argues, requires a “diverse STEM workforce.” Why this is the case they don’t bother to say. Somehow, NSF-backed scientists managed to rack up more than 200 Nobel Prizes before the agency realized that scientific progress depends on “diversity.” No matter: in July 2017, it awarded $1 million to the University of New Hampshire and two other institutions to develop a “bias-awareness intervention tool.” Another $2 million went to the Department of Aerospace Engineering at Texas A&M; to “remediate microaggressions and implicit biases.” The science diversity charade, as I discuss in my book The Diversity Delusion, wastes extraordinary amounts of time and money that could be going into basic research and its real-world application. If that were its only consequence, the cost would be high enough. But identity politics is altering the standards for scientific competence and the way future scientists are trained. “Diversity” is now an explicit job qualification in the STEM fields. The physics department at UC San Diego advertised an assistant-professor position with a “specific emphasis on contributions to diversity,” such as a candidate’s “awareness of inequities faced by underrepresented groups.” Solving the mystery of dark energy apparently now takes a back-seat to social justice. Maybe it was a coincidence, but all five candidates on UC San Diego’s short list were females. If traditional standards are keeping women and minorities out of STEM fields, it stands to reason that changing standards must be the way to get them in. Or maybe standards are just another expression of the white patriarchy and thus no longer relevant. An introductory chemistry course at UC Berkeley reflects the new “culturally sensitive pedagogy.” A primary goal, according to its teachers, is to disrupt the “racialized and gendered construct of scientific brilliance,” which defines “good science” as getting all the right answers. This same diversity obsession extends to medical schools—not a happy thought when they wheel you into the operating room for emergency surgery. The promoters of identity politics are literally playing with our lives. Medical schools admissions committees are now told to overlook the low test scores of black and Hispanic applicants in favor of a more “holistic” approach. From 2013 to 2016, medical schools admitted 57 percent of black applicants with a low medical college admission test score of 24 to 26, but only 8 percent of whites and 6 percent of Asians with those same low scores, according to Claremont McKenna professor Frederick Lynch. There is an impressive memorial to him in Washington, DC, and a museum celebrating his life in Atlanta, Georgia. Countless schools and boulevards have been named after him, and a national holiday is dedicated to his memory. How is it, then, that so much of his legacy—what he hoped to pass on to the future—has been lost? King wanted equality under the law and said, famously, that people ought to judge one another based on character, not skin color. But he also believed that blacks had an important role to play in their own advancement. The black civil rights battles in America are now over, and King’s side won. The best indication of that may be that King has had no real successor. If black Americans were still faced with legitimate threats to civil rights—such as legal discrimination or voter disenfranchisement—it’s likely that leaders of King’s caliber would have emerged to carry on the fight. Instead, what we have today are pretenders who have turned the civil rights movement into an industry, if not a racket. And what have these racketeers accomplished? A lot for themselves, and very little for their constituents. Racial gaps in income, education, and home ownership were narrowing in the 1940s, ’50s and ’60s. But after King was replaced as the spokesman for black America by the likes of Jesse Jackson, Al Sharpton and others, these gaps began to widen in the 1970s, ’80s and ’90s. This suggests that the racial disparities that continue today aren’t driven by whatever racism that still exists, despite all the claims to the contrary from progressives and their allies in the media. It also suggests that black culture—attitudes toward marriage, education, work and the rule of law—plays a much larger role than the left wants to acknowledge. More marches won’t address fatherless homes. More sit-ins won’t lower black crime rates or narrow the school achievement gap. Electing more black politicians and appointing more black government officials can’t compensate for these cultural deficiencies, either. Black mayors, congressmen, senators, police chiefs and school superintendents have become commonplace since the 1970s. Even the election of a black president—twice—failed to close the racial divide in many key measures. Black-white differences in poverty, home ownership, and incomes all grew wider under President Obama. Discussion of antisocial behavior in poor black communities, let alone the possibility that it plays a significant role in racial inequality, has become another casualty of the post-’60s era. King and other black leaders at the time spoke openly about the need for more responsible behavior. After remarking on the disproportionately high inner-city crime rates, King told a black congregation in St. Louis that “We’ve got to do something about our moral standards. We know that there are many things wrong in the white world,” he said, “but there are many things wrong in the black world, too. We can’t keep on blaming the white man. John Stossel Published on Dec 18, 2018 The new film "The Creepy Line" argues that tech giants sometimes silence conservatives and try to steer America left.  Leaked emails show some Google engineers blaming their company for Trump's 2016 win, suggesting that the site should censor outlets like the Daily Caller and Breitbart. Google says the company never did that, but for many people, it raises the question: Could Google executives flip an election? "Google's senior management was heavily in favor of Hillary Clinton,” The Creepy Line writer Peter Schweizer tells John Stossel. "Their ability to manipulate the algorithm is something that they’ve demonstrated the ability to do in the past ... and the evidence from academics who monitored 2016 was clearly that they did." Schweizer's film features psychologist Robert Epstein, whose research claimed that people rated Google's top search results in 2016 as more positive to Hilary Clinton than to Donald Trump. Stossel says that it doesn't prove that Google's results were biased; it may just be that major media outlets ran more positive headlines about Clinton, and since Google's results rely on the major media, that would bring more positive Clinton headlines, even without any bias on Google's part. Even if Google's search algorithm is fair, major social media outlets do manipulate us by determining what we can not see. The film plays a clip of psychologist Jordan Peterson, who points out: "They’re not using unbiased algorithms to do things like search for unacceptable content on twitter and on YouTube and on Facebook -- those aren’t unbiased at all. They’re built specifically to filter out whatever’s bad." Stossel notes that Google and Facebook employ human content monitors -- some of whom despise conservatives -- to determine what is "bad." Peterson himself has reason to worry. After he criticized a Canadian law that would mandate use of people's preferred pronouns (like "Ze" or "Xir”), Google briefly shut down Peterson's Youtube channel. They even blocked him from his own Gmail account. "That’s a real problem," says Peterson. "You come to rely on these things and when the plug is pulled suddenly then that puts a big hole in your life." Stossel wonders: what can consumers do about possible social media manipulation or censorship? One speaker in Schweizer’s film says, “delete your accounts!” Stossel tells Schweizer: "I don’t want to delete my accounts -- and you can’t, without cutting yourself off from much of the best of the world." Schweizer admits that it's a challenge, but says he's switched to Google's competitors. For simple searches, Schweizer uses DuckDuckGo.com instead of Google. For email, Schweizer uses the encrypted service ProtonMail.com, based in Switzerland, rather than Gmail. The web browser "Brave" provides an alternative to Google's Chrome. Brave was founded by Brendan Eich, who created the browser Firefox but was then forced to leave his own company because he once donated to a ballot proposition against gay marriage. But most people won’t switch. Stossel hasn’t switched. He wonders if a few individuals switching will change much. "That’s all we have? A pathetic act that won’t make any difference?" he asks. Schweizer replies: "If people make clear to Google that they don’t like their manipulation, and they don’t like their invasion of privacy ... they will be forced to make changes. That’s part of the reason we love and support the market the way we do."     End Racial Preferences at Colleges? John Stossel Published on Jan 2, 2019 Asian Americans are suing Harvard for illegally discriminating against them The lawsuit forced Harvard to release admissions data which reveal that admitted Asian applicants score 22 points higher on the SAT than whites and 63 points higher than blacks. Harvard admits to using race as a factor in admissions for the sake of diversity. But the school says it does so without any hard quotas or race-based points system -- that they merely consider it informally. Past Supreme Courts have allowed that. But the Asians suing Harvard argue that the university gives them artificially low personality ratings to keep their admissions rate down. They say Harvard treats Asian Americans as "boring little grade grubbers." Harvard's data show that a typical asian applicant is less than half as likely to get a good personality rating in Harvard's admissions process than a typical black applicant. Lee Cheng of the Asian American Legal Foundation says the data show clear, systematic discrimination based on race. "Harvard didn't just use race as one of many factors. It was the determinative factor," Cheng tells Stossel. Many experts say that Harvard's case may reach the Supreme Court. If it does, then the court -- with President Trump's new appointees -- might strike down all college racial preferences. Ending racial preferences would increase the share of Asian and white students in colleges, but decrease the share of black and hispanic students. Harry Holzer, an economist and Harvard Alum who studies affirmative action, says that would be a big mistake. "When you have a long history of discrimination based on race, you have to take race into account," Holzer tells Stossel. But Cheng says Harvard's preferences don’t help disadvantaged people. “Race based affirmative action helps rich people ... Seventy percent of the students of every ethnic group at Harvard come from the top 20 percent of family income," Cheng tells Stossel. Holzer responds: "It's okay ... race in America matters at any level of income." But Cheng responds that when wealthy people use race to get a leg up, poor whites and poor Asians get hurt. He first became passionate about racial discrimination when he faced it in high school. San Francisco had a strict racial quota for admission to the Lowell public magnet high school. Because there were many Chinese kids in the area, Cheng and other Chinese Americans had to score higher than kids of other races. "I was just shocked," Cheng tells Stossel. "I was just taught in civics and history that in America everybody was supposed to be equal under the law." Cheng got in, but he says he saw many of his friends get left behind because of racial preferences. "The kids who were negatively affected ... were the kids of the dishwashers and the seamstresses and who lived in Chinatown, who were very poor." Cheng eventually sued San Francisco and forced them to end their quotas. Now he hopes the lawsuit against Harvard will do the same to universities. "I have three kids," Cheng says. "I'll be damned if I'm going to not fight very, very hard to make sure that they don't get treated as second class citizens in the land in which they were born."     Media Hype Questionable Gun Control Study John Stossel Published on Dec 14, 2018 Dozens of news outlets reported that America has the most mass shooters in the world. Many say that shows America needs more gun control  CNN claimed that "the U.S. has the most mass shootings". The WSJ reported that "U.S. leads the world in mass shootings." Nearly every major media outlet and former President Obama said the same. But the claim is based on just one study, and the author of that study, Adam Lankford, would not release his data to other gun reseachers in the field. Economist John Lott argues that Lankford's study has many flaws. Lott is the author of the books “More Guns, Less Crime” and “Bias against Guns.” His son, Maxim Lott, works for Stossel TV. Stossel says because of that, he repeatedly asked Lankford to show him the study data that he would not reveal to Lott. But Lankford would not disclose it to Stossel either. Lankford claimed to find "complete data" for all mass shootings in 171 countries from 1966 to 2012. But Lott notes that Lankford doesn’t reveal basic details about how he found shootings in so many countries -- most of which don’t speak English. And most of those years, those countries didn’t have the internet. Lott argues that finding complete data for mass shooters in just one developing country, such as India, would be an incredible feat, as many shootings would be reported only in local outlets in the local language. U.S. mass shootings, on the other hand, are well-documented and hard to miss. Lott says that if Lankford missed foreign cases but found all the U.S. ones, his paper’s entire conclusion that the US has the most mass shooters could fall apart. Lankford has declined to answer questions about how he searched for foreign-language cases. Did Lankford miss foreign cases? Because Lankford would not release his data, Lott and the think tank he runs -- the Crime Prevention Research Center -- compiled their own count of mass shooters. (His paper is at http://ssrn.com/abstract=3238736 ) Lott counted more than 3,000 cases around the world -- several times more than the 202 cases Lankford found. Lott found 15 times more, despite the fact that he only looked for shootings in the last 15 years, whereas Lankford looked at 46 years. Lott attempted to use the same definition of "mass shooter" that Lankford used, although that’s difficult. In Lankford's paper, Lankford says he excludes "sponsored terrorism" but does not define what he means by that. To be safe, Lott removed all terrorism cases from his data. When he did that that, he still found 709 shooters around the world -- more than 3 times what Lankford found. Gun control advocates have used the Lankford study to argue that mass shootings are caused by the comparatively high gun ownership rate in the U.S. But when Lankford's data are fixed, Lott says, there is no longer any correlation between gun ownership rate and mass shootings. Lott concludes: "There is a lesson here. Lankford’s critical but simple error could have been picked up if journalists had only demanded his data and methods before publicizing his study.” That’s something journalists rarely do. Lott adds: "Journalists should learn to be skeptical... and in the meantime, we should all be skeptical of news coverage of studies like this -- that simply confirm what journalists and people want to hear."   Stossel’s Book recommendations on Liberty Stossel's Stocking Stuffers John Stossel Published on Dec 11, 2018 Holiday season is here. To help your friends or family learn about liberty, why not give them a book John Stossel has some ideas. First, there's The Road to Serfdom. In it, Friedrich Hayek explains why government intervention in the economy leads to serfdom. He explains why no central planner can allocate resources as well as individuals can. Stossel says this is a great book for your socialist friends -- if they are willing to read it. They might not be, Stossel says, because language is old. Thomas Sowell’s Basic Economics is more current. Sowell explains that trade is not a zero-sum game -- it's not as if one country wins and another loses. Both sides benefit. Stossel suggests that someone should give Sowell’s book to our President. Another myth-busting book is The Myth of the Robber Barons. Historian Burton Folsom explains that Cornelius Vanderbilt and John D. Rockefeller didn’t get rich by robbing people. They got rich by creating better things. Another good book that will educate someone about basic economics is Free to Choose by Milton and Rose Friedman. Stossel also briefly mentions a bonus book by a former clueless, lefty, big-government loving reporter who finally woke up to the benefits of markets. That book is Give Me a Break. Prefer fiction? Stossel recommends two classics, Atlas Shrugged by Ayn Rand and Animal Farm by George Orwell. Any of these books, Stossel says, would make a great Christmas gift.   Google and Facebook Cross "The Creepy Line" John Stossel Published on Dec 4, 2018 Companies like Google and Facebook collect information about us and sell it to advertisers. The information they collect and the way they collect it cross the "creepy line” according to a new documentary called "The Creepy Line.” John Stossel asks the writer of the documentary, Peter Schweizer: “What’s the big deal? They're giving me information.” Schweizer responds “to the extent that somebody can do something for you, they can do something to you.” He goes on to make a powerful case that Google and Facebook abuse their power. The documentary says that Google tracks you even when you are not online. As soon as you connect to the internet, Android uploads to Google a complete history of where you’ve been that day. Schweizer wants Google and Facebook to be regulated like media companies. Stossel is skeptical "You want regulation? That's going to make it better?” he asks. Schweizer answers: “one of the ways you deal with Google's market concentration, and its massive control of search is, put it under the same shackles [as] other media companies.” Stossel doesn’t presume to know what, if anything, ought to be done about Google and Facebook. But he says that the documentary makes a compelling case that these giant companies do creepy things.   Socialism Leads To Violence John Stossel Published on Nov 27, 2018 Socialism is now cool in some circles. Newly elected Congresswoman Alexandria Ocasio-Cortez praises "Democratic Socialism" and told comedian Stephen Colbert, "in a modern, moral and wealthy society, no person in America should be too poor to live  Colbert ate it up. "Seems pretty simple!" he replied, to cheers from his audience. But socialism shouldn't be cool, Gloria Alvarez reported recently, noting that it wrecks economies. In this video she points out that it also leads to government using force against its own citizens. Regimes that call themselves socialist have killed millions of people. Tens of millions were killed in the USSR. Same in China. Millions also died in Cambodia and North Korea, which claimed to follow socialist ideals. Today’s socialist say that those countries didn't do "real" socialism. They promise that their experiment will be different, and better. "Democratic socialists" like Sen. Bernie Sanders and Alexandria Ocasio-Cortez certainly promise to avoid anything like the horrors of previous self-described socialist governments. But Alvarez says that socialism, whatever the variant, tends to turn out the same way. Right now, people die in Latin American countries that fell for socialism's promises. In Cuba, because government restricts private property and trade, Cubans trade on the black market to survive. Sometimes government violently cracks down on them. Alvarez interviews Ibis Valdes, who says: "my father was a political prisoner [in Cuba] for almost a decade ... because in his 20s he sold soaps and perfumes and did not want to relinquish all of his profits to the government." Michel Ibarra, who escaped Cuba, says: "Socialism is the perfect excuse for someone who wants to rule an authoritarian regime." Political violence in the name of socialism also occurred in Nicaragua and Venezuela. Alvarez interviews Ramón Muchacho, a former mayor of a section of Venezuela's capital city, Caracas. He tell Alvarez that he was pressured by socialist leaders to use his police force to brutally suppress protests against the regime. Because he refused, he was threatened with jail. He fled to America. "It seems to me we are not able to learn," Ramón Muchacho tells Alvarez. "[Politicians] will always be dreaming about the future and never delivering. People keep falling in love with that kind of crap." Alvarez hopes that some will learn. Gustavo Tefel, who fled violence in Nicaragua tells her that he did. "I don’t think [people] realize how deep socialism is involved in all [the violence]... America is a great country. People really don't appreciate it much ... they should travel a little more to poor countries to really get a feeling for what they have here in the United States. Just look around, you know, and really get some knowledge."   Let Them Vape John Stossel Published on Nov 20, 2018 Our government says e-cigarettes/vaping is the latest "epidemic" among teens. So the FDA says they will restrict them. Cities across the country are banning e-cigarette use in public. But e-cigarettes help smokers quit traditional cigarettes. Michelle Minton of the Competitive Enterprise Institute tells John Stossel that people have misconceptions about e-cigarettes. “It's about 95% less harmful than a normal traditional cigarette.” That’s because e-cigarettes let people get a hit of nicotine without actually burning tobacco. The burning of paper and tobacco leaves is what makes cigarettes so dangerous. Minton admits that the nicotine in e-cigarettes is addictive. But she says, “on the spectrum of drugs that you can become addicted to, nicotine and caffeine are very similar to each other.” The Surgeon General says there are other health risks to vaping: “Besides nicotine, e-cigarettes can contain harmful and potentially harmful ingredients.” Despite the dangers, researchers seem to agree that e-cigarettes are substantially less dangerous than combustible cigarettes. Other studies concluded that long-term e-cigarette use is “associated with substantially reduced levels of measured carcinogens and toxicants relative to cigarette-only smoking.” Nevertheless, the FDA threatens to crack down to discourage kids from using e-cigarettes. Minton says that is a bad idea: “Do we want children to become addicted to anything? No ... Soundcloud: https://soundcloud.com/dan-bongino Android: http://subscribeonandroid.com/feeds.s...   The following article can be found at- https://amgreatness.com/2018/12/30/our-exhausted-american-mediocracy/   Our Exhausted American Mediocracy By Victor Davis Hanson| December 30th, 2018 The unlikely 2016 election of Donald Trump—the first president without either prior political or military office—was a repudiation of the American “aristocracy.” By “rule of the best” I mean the ancien régime was no longer understood to suggest wealth and birth (alone), but instead envisioned itself as a supposed national meritocracy of those with proper degrees, and long service in the top hierarchies of government, media, blue-chip law firms, Wall Street, high tech, and academia. The 2016 election and refutation of the ruling class did not signal that those without such educations and qualifications were de facto better suited to direct the country. Instead, the lesson was that the past record of governance and the current stature of our assumed best and brightest certainly did not justify their reputations or authority, much less their outsized self-regard. In short, instead of being a meritocracy, they amount to a mediocracy, neither great nor awful, but mostly mediocre.   This mediocracy is akin to late 4th-century B.C. Athenian politicians, the last generation of the Roman Republic, the late 18th-century French aristocracy, or the British bipartisan elite of the mid-1930s—their reputations relying on the greater wisdom and accomplishment of an earlier generation, while they remain convinced that their own credentials and titles are synonymous with achievement, and clueless about radical political, economic, military, and social upheavals right under their noses.   Remember the “new normal”? Our economic czars had simply decided anemic economic growth was the best Americans could expect and that 3 percent annualized GDP growth was out of the realm of possibility. Big government incompetence combined with Wall Street buccaneerism had almost melted down the economy in 2008. Recent presidents had doubled the debt—twice.   Few could explain how recent agreements such as the Paris Climate Accord or Iran deal could ever have achieved their stated aims, much less were in America’s interest. War planners had not translated interventions in Afghanistan, Iraq, and Libya into strategic advantage—much less lasting victory—and never offered reasons to be in such places that appealed to half the country.   Most elites had assumed the deindustrialized red-state interior was doomed to a sort of preordained and irreversible decline, much of it supposedly self-induced. In more candid moments, elites jested that red-state losers might be better replaced by new immigrants, both legal and illegal.   Our ruling classes either could not or would not defend American traditions and civilization in our colleges, in our government, and in our popular culture—and they were increasingly accepting of the globalist consensus that America had a flawed past requiring some sort of reparatory future.   Our leadership accepted a world in which America’s misdemeanors were the source of global outrage, while China’s felonies were largely exempt from criticism. China’s global hegemony was seen as assumed and fated. Efforts to derail it were near inane or retrograde.   Most Americans figured that those who lectured them on television, in op-eds, and throughout popular culture about guns, open borders, green mandates, fossil fuels, and the public schools, had the money, desire, and clout to live in desirable neighborhoods, sometimes behind walls, with ample taste for fine cars, jet trips, and private academies for their children.   Earned Hypocrisies? The charge of hypocrisy against the elite was considered juvenile—given that exemptions were needed for the ruling class to serve us all the better.   How could Al Gore save us from our carbon emissions without his private jet? How could Nancy Pelosi craft drastic climate change legislation without flying to a Kona resort over the holidays?   How could Eric Holder stop prejudice without a jet junket to the Belmont Stakes with his kids? How could our Malibu elite nobly sermonize about their loyal gardeners and dutiful maids without walled estates?   How could Silicon Valley wizards pontificate about the evils of charter schools and the need for teacher unions, without private academies for their own? And how exactly could the heads of our intelligence agencies and justice department officials track down the crimes of Donald Trump without committing greater ones themselves?   Much of the Trump agenda, although nominally embraced by the Republican Party after the July 2016 convention, was largely crafted in antithesis to the bipartisan status quo that either could not or would not end illegal immigration, secure the border, call China out on warping world trade, seek greater reciprocity with allies, curtail optional military interventions, massively deregulate, expand fossil fuel production, and return the federal judiciary to a constitutional and constructionist framework.   If such a nontraditional agenda had been advanced by an “acceptable” outsider or billionaire such as Warren Buffett, Bill Gates, or Michael Bloomberg, it would have been seen as eccentric but nevertheless not blasphemous. However, Donald Trump advertised himself as a renegade whose own notorious apostasy was inseparable from his message, and who felt no allegiance to the political protocols and customs that had prepped past presidents. Trump’s often crude demeanor at times seemed to suggest that he was not just interested in revoking the results of status quo policymaking, but the very premises of the status quo itself.   It is easy to suggest that much of the unprecedented hatred shown Trump is the poisoned fruit of his alleged toxic persona. And yet it is hard to calibrate whether any president has faced, from the moment of his election, the level of venom shown Trump by both political parties, and by the elite media, and the centers of progressivism on Wall Street, in Hollywood, Silicon Valley, Washington, and New York.   A country that once banned for life a clown from a state fair for wearing in puerile fashion a Barack Obama mask now ritually talks of impeaching, committing to an institution, overthrowing, or beating, burning, decapitating, blowing up, and shooting the elected president.   Certainly, we have never seen anything like the constant anti-Trump media hatred, the efforts since the election to remove Trump, in slow-motion coup style, by seeking to warp the Electoral College, to invoke the 25th Amendment and the Emoluments Clause, to unleash special counsel Robert Mueller with an unlimited budget, a toadyish media, a team of partisan lawyers and investigators, and prior help from the top echelons at the Obama Department of Justice, the FBI, the National Security Council, and the CIA.   The argument of these elites and their institutions has been not just that Trump is incompetent or inexperienced, but that he is corrupt, perverse, treasonous, criminally minded, and to such a degree that the results of the 2016 should be overturned before the 2020 election. And such an end to Trump’s elected governance is justified not merely by his toxic person, but also by the racist, sexist, nativist, xenophobic Americans—the counterfeit half of the country—who elected him.   A Case Against Trump? If these arguments of the American aristocracy were valid, we would have to accept three arguments of the best and brightest:   1) There is a clear moral, legal and popular prerogative to remove Trump.   Yet for all the efforts of the professional politicians, the lockstep media, and the elite academic, legal, and financial communities, there is neither a rational nor legal basis to remove Trump. Instead, he enjoys about the general level of support as did many past presidents at this juncture in their administrations. He has survived his first midterm in better fashion than did either Bill Clinton or Barack Obama who were both later easily reelected.   No one has yet argued that the tenures of John F. Kennedy, Lyndon Johnson, or Bill Clinton—still enshrined in the progressive pantheon—were marked by less crudity. The record of the Department of Veterans Affairs, Environmental Protection Agency, General Services Administration, IRS, CIA, and FBI between January 2009 and January 2017 does not qualify as “scandal free.”   It’s unlikely Trump will be convicted of any crimes as outlined by the Mueller collusion investigation. It is more likely he will prove to be the most investigated, probed, and audited president in history. And even more likely, top officials at the Justice Department, CIA, and FBI will be facing eventual legal exposure for unethical and illegal efforts to damage the Trump candidacy, transition, and presidency.   2) Trump has failed.   For all the perceived chaos and disorder in the Trump Administration, it certainly has so far achieved a stronger economic record than did his predecessors, whether adjudicated by GDP growth, unemployment, energy production, or deregulation.   Even a shaky stock market is still much higher than it was when Trump took office. Likewise, abroad, for all Trump’s supposed unpopularity, privately most Americans and many so-called experts agree that the Iran Deal was fatally flawed, the Paris Accord was a charade, the “Palestinian” problem was ossified, a radically new policy toward China was overdue, the Pentagon needed to be recalibrated, and old American partnerships were in dire need of recalibration from NATO to NAFTA.   3) There is a logical and systematic antithesis to Trumpism.   If so, will either primary or general election candidates run on open borders being preferable to secure ones? Eliminating ICE is better than maintaining it? Defense cuts are necessary? Far more gun control? Medicare for all?   There is too much American natural gas and oil production? The economy would be better off with higher unemployment and slower growth? Food stamps need to be increased not reduced by over 3 million recipients?   We are too harsh on Iran and too accommodating of Israel? Taxes are too low, government too small, and entitlements too few? Did Trump appoint too many unqualified strict constructionist judges? Were John Bolton and Mike Pompeo incompetent?   Whom Are We To Trust? As we look to our celebrities, billionaires, intellectuals and senior statesmen, a sort of American pantheon, do we to find sources of reassurance in Hollywood, perhaps in the statements and behavior of the last two years of Cher, Barbra Streisand, Robert De Niro, Johnny Depp, or Madonna? Do the Oscars, Tonys, and Emmys showcase the expertise, competence, and professionalism of our entertainers?   Do the recent statements of the elite marginalized—a LeBron James, Alice Walker, or Tamika Mallory—remind us to reset our ethical bearings, or do they instead suggest that intersectionality can at times exempt, rather than serve as an impediment to, anti-Semitism? Has Alexandria Ocasio-Cortez shown us superior erudition and common sense?   Perhaps Harvard, now facing allegations that it systematically discriminated on the basis of race, can reassure us of progressive values in these tough times? Can its first Native American professor Elizabeth Warren help us endure Trump? Or maybe Google, Facebook and Twitter can show us the way to protect our civil liberties, free expression, and non-partisanship?   Do the heads of our major entertainment and news organizations, a Harvey Weinstein and Les Moonves, offer sources of refuge in these supposedly dark Trump years? Have trusted journals like The New Republic or Der Spiegel been reliable beacons of truth?   Perhaps we can look to the elite of the media, to the careers of Dan Rather, Brian Williams, Matt Lauer, Charlie Rose, or Mark Halperin, or stellar writers such as Leon Wieseltier, Glenn Thrush, or Garrison Keillor to help us recover our moral bearings. Could a wide array of our best intellectuals, politicians, and activists help find our way home in in the age of Trump, perhaps truth tellers such as Doris Kearns Goodwin, Al Franken, or Dianne Feinstein?   Could not Joe Biden weigh in on the evils of plagiarism, Cory Booker cite the dangers of fabulism, Harry Reid warn of racial stereotyping, or Kamala Harris on the perils of religious bigotry?   Maybe the elites of government will be our touchstones. Trump critic, James Comey, the director of the FBI, has told Congress on 245 occasions during a single appearance that he does not know or cannot remember the answers when asked questions.   The cable television critic and former Director of National Intelligence James Clapper had lied under oath to Congress and fabulously claimed that the Muslim Brotherhood in Egypt was largely secular.   John Brennan, another cable television consultant and the former CIA head, has trumped Clapper by lying twice to Congress. Brennan also claimed that jihad was little more than a personal introspective religious journey.  Are these our watchtowers of sobriety in these dark times?   Both Hillary and Bill Clinton, by education, careers, and service, are advertisements of the ruling class. Yet, she was the godmother of the disastrous Libyan incursion, knee-deep in scandal from cattlegate to Benghazi to Uranium One, and hired a foreign national during the 2016 election to find dirt on her political opponent through the paid services of foreign sources. Bill was impeached and somehow ended up worth well over $100 million largely by selling influence on the premise he and his spouse would one day be back in the White House. The Clinton Foundation is synonymous with corruption.   So do the most acerbic critics of Trump and iconic members of our aristocracy inspire confidence?   Former National Security advisor Susan Rice, to take just one recent example of a prominent critic in the news, lied repeatedly about the Benghazi attacks, about the Bowe Bergdahl swap (the Army deserter  served, she said, “with honor and distinction”), about the sordid details of buying back hostages central to the Iran deal (“And we were very specific about the need not to link their fate to that of the negotiations”), about the elimination of weapons of mass destruction in Syria (“We were able to get the Syrian government to voluntarily and verifiably give up its chemical-weapons stockpile,”) and about the unmasking of names surveilled through FISA court warrants (“I know nothing about this”).   The point of this tour of our elite is not to excuse Trump’s often retaliatory crassness or bombast, but to remind us that our self-righteous anti- and pre-Trump aristocracy was so often a mediocracy. It had assumed status and privilege largely on suspect criteria. Its record abroad and at home inspired little confidence. Doing mostly the opposite of what elite conventional wisdom advocated since January 2017 has made the nation stronger, not weaker.   Strangest of all, the elite’s furious venom directed at Trump, couched in ethical pretense, has had the odd effect to remind the American people how unethical and incompetent these people were, are, and likely will continue to be.
