Doug McHoney (PwC's US International Tax Services Leader) and Pam Olson (PwC's US Deputy Tax Leader and Washington National Tax Services Leader) discuss technical corrections as a way to 'fix' scrivener's errors, missed cross-references and drafting mistakes in legislation. Topics covered include: what is a technical correction; why unintended consequences may not qualify as technical corrections; could the budget reconciliation process be used; additional legislative and regulatory processes and arrangements for implementing technical corrections; the history and future of technical corrections; and the potential for technical corrections legislation to address errors and issues specifically identified in the Tax Cuts and Jobs Act. We also learn how 'the four horsemen' (the chairmen and ranking members of both tax writing committees) can request Treasury to follow legislation not as drafted, but as intended. In addition, Pam addresses whether we might see tax extender legislation.
