The first transgression comes from (ויקרא י"ט ט"ז): ''לֹא תֵלֵךְ רָכִיל בְּעַמֶךָ''. This is a reference to the initial stage of Lashon Hara in which the speaker "spies out the negative" to speak about. Klal Yisroel was punished 40 extra years in the desert as a result of the 40 days of spying on Eretz Yisroel which resulted in Lashon Hara about the land. Why was the punishment 40 years if the actual transgression was only done on one day? The main transgression was not the negative speech itself but it was the negative attitude they had as they were spying which spanned 40 days. This is true of all Lashon Hara, the main issue is the negative perspective that a person has about another and the speech which it results in is only the completion of the prohibition.
