In today’s session, we will discuss a topic that is at the forefront of every business’s concerns at the beginning of 2026: labor law compliance. This is because the changes introduced this year go far beyond paperwork. They directly affect HR operational processes, human resources data management, and potential dispute risks if businesses fail to implement them properly.
In this episode, we will walk through four key areas that businesses should pay close attention to:
(i) Electronic labor contracts;
(ii) Updates on regional minimum wages;
(iii) Wages and social insurance obligations for part-time employees; and
(iv) Obligations relating to personal data protection in the recruitment, management, and use of employees.
1. Electronic labor contracts
On 24 December 2025, the Government issued Decree No. 337/2025/ND-CP (“Decree 337”) on electronic labor contracts, which took effect from 01 January 2026, marking a significant step toward the digitalization of labor management. An electronic labor contract is a labor contract concluded and established in the form of a data message in accordance with labor laws and electronic transaction laws, and it has the same legal validity as a paper-based labor contract.
