The Immigrant Blueprint

4. Things you need to know if you are applying for a green card through VAWA!⠀

Listen Later

On this episode Ebony Anuforo will be talking about VAWA, the Violence Against Women Act, an immigration benefit that allows victims of domestic violence or abuse who are married to US citizens or residents, to apply for their green card on their own. On this episode she shares several things you should consider if you are thinking of applying for this immigration benefit, such as:

1.      Physical abuse is not the only abuse that qualifies you, so does, emotional, psychological, sexual and financial abuse.⠀⠀⠀⠀⠀⠀⠀⠀⠀

2.      A police report is not required as evidence.⠀⠀⠀⠀⠀⠀⠀⠀⠀
3.      A waiver for your unlawful entry is possible.⠀⠀⠀⠀⠀⠀⠀⠀⠀
4.      You are not required to stay married to your abuser, so if you want to leave the marriage…go ahead.⠀⠀⠀⠀⠀⠀⠀⠀⠀
5.      If you do divorce…you have up until two years from when the divorce became final to apply. ⠀⠀⠀⠀⠀⠀⠀⠀⠀
6.      If you want to stay married you can…VAWA is still available to you even if you stay married to your abuser.⠀⠀⠀⠀⠀⠀⠀⠀⠀
7.      Your spouse is not part of the process. This is your self petition.

Remember Immigration is a very complicated area of law, and if you have an immigration case, you should consider speaking with an experienced licensed attorney.
