Federal Grand Jury Secrecy Rules: What You Need to Know

Federal grand juries operate under strict secrecy requirements. The primary authority is Rule 6(e) of the Federal Rules of Criminal Procedure (Fed. R. Crim. P. 6(e)), which governs what can and cannot be disclosed about proceedings.

Key Rules on Disclosure

* Secrecy Requirement: All matters before a grand jury are confidential, including the existence of an investigation, testimony, evidence, and deliberations.

* Who Must Keep It Secret: Prosecutors, court staff, interpreters, stenographers, and the jurors themselves are legally bound to secrecy.

* Exceptions: Disclosure is permitted only in narrow situations, such as by court order, when necessary for government attorneys or investigators performing official duties, or when information is shared with another grand jury.

What Happens if Someone Violates Rule 6(e)?

Breaking grand jury secrecy is not just frowned upon — it can be a federal crime. Possible charges include:

* Contempt of Court (18 U.S.C. § 401): Courts can punish anyone who disobeys Rule 6(e) secrecy obligations with fines or imprisonment.

* Obstruction of Justice (18 U.S.C. §§ 1503, 1512, 1519): Leaking grand jury information with intent to interfere in an investigation or proceeding can lead to felony charges for obstructing justice.
