ABSTRACT: The government is the party that proposes the Draft Law on Work Creations which is currently being discussed by the Indonesian Parliament. The discussion on the Draft Law on Employment Employment has drawn many protests from various parties, including Workers who openly reject their actions based on the exclusion of Workers / Laborers in the discussion process and the substance of the Labor Cluster also changes many articles which are protection from Country to workers in Law Number 13 of 2003 concerning Labor. Research is a Legal Research that uses a historical and conceptual approach. The conclusion of this research is the Constitution of the Republic of Indonesia which has clearly mandated the protection of workers which is not at all depicted either in the Academic Paper or the Draft Law on Employment.
