Massachusetts DCF mandated reporters, non-mandated reporters, and anonymous reporters follow different rules when reporting suspected child abuse or neglect. In Boston Barrister EP57, Attorney Kevin Seaver explains who may file a 51A report, which professionals are mandated reporters, and why identifying the source of an allegation may matter.

Welcome to the Boston Barrister. My name is Kevin Patrick Seaver, and I am from Boston, Massachusetts. This week we are discussing mandated, non-mandated, and anonymous reporters, including the professionals who most often file reports of suspected child abuse or neglect. Schools are frequent reporters, including principals, teachers, guidance counselors, school nurses, and other professionals who work closely with children. Other mandated reporters include law enforcement officers, medical professionals, social workers, daycare staff, therapists, psychologists, clergy, foster parents, probation officers, and emergency medical personnel. A mandated reporter has a duty to contact the Massachusetts Department of Children and Families when they suspect child abuse or neglect. A non-mandated reporter is someone who does not fall within a legally designated mandated-reporting profession. An anonymous reporter provides no identifying information, while a mandated reporter must disclose their identity and contact information. DCF usually investigates allegations submitted by other people rather than filing the original report itself. Attorney Seaver explains that an allegation does not mean it is true and says parents should respond carefully, gather information that supports their account, and avoid talking themselves into a supported decision. He emphasizes taking prompt action because addressing a false allegation during the investigation may help prevent a longer assessment or Fair Hearing.
A Massachusetts DCF investigation can move quickly, sometimes leading to important decisions within days or even hours. In Boston Barrister EP56, Attorney Kevin Seaver explains why parents should act promptly, understand the process, and protect their parental rights when DCF contacts their family.

Welcome back to the Boston Barrister. My name is Kevin Patrick Seaver, and I am located in Boston, Massachusetts. Today we want to speak about how DCF investigations move fast and how your family’s safety and parental rights may be on the line. DCF can sometimes make decisions concerning your children within days or even hours, so you need to understand the process from start to finish. A 51A report may be filed by a mandated, non-mandated, or anonymous reporter rather than by DCF itself. These reporters may contact DCF when they have suspicion or reasonable cause to believe that abuse or neglect occurred. DCF may then interview you, your children, and the reporter before making a decision within a short period of time. Attorney Seaver says time is of the essence and that parents should not allow the process to run over them like a bulldozer or Mack truck. He encourages parents to understand their rights, protect their children, and contact a lawyer promptly after DCF reaches out. Problems do not get smaller, so address the DCF matter immediately upon being contacted.
What should parents do when Massachusetts DCF first contacts them? In Boston Barrister EP53, Attorney Kevin Seaver explains why parents should listen carefully, identify the allegations, avoid guessing, and prepare a clear plan before responding.

Welcome back to the Boston Barrister. My name is Kevin Patrick Seaver, and I’m located in Boston, Massachusetts. Today’s podcast is about what you should do when DCF first contacts you. The first thing you should do is listen carefully and find out what the allegations are before answering questions. If you do not know the story, you may start guessing, and guesses are not made for investigations. Every family, DCF officer, social worker, and set of circumstances is different, but the law and the need to protect your constitutional rights do not change. DCF may inspect your home, contact doctors, nurses, schools, therapists, and other collateral sources, and review your background and any prior DCF or police involvement. Understanding the DCF process, procedures, time standards, statutes, regulations, and law can reduce fear by helping you understand what may happen next. Parents should prepare evidence, facts, affidavits, character references, and other documentation instead of assuming DCF will see through the allegations without help. Understanding the 51A report, 51B investigation, home visit, and your options allows you to make informed decisions, follow a step-by-step strategy, and act early to protect your children and family.

Welcome back to the Boston Barrister. My name is Kevin Patrick Seaver, and I am located in Boston, Massachusetts. This week’s topic is Lindsay Clancy and how her husband, Patrick Clancy, and his new wife, Rachel, appeared on CBS’s 60 Minutes on Sunday, September 20, 2026. This was Rachel’s first public appearance concerning the case, and she did not testify or attend the trial. The interview discussed how Patrick and Rachel met, their marriage, and how the Plymouth Superior Court trial and intense media attention have affected their lives. Rachel supported Patrick against online conspiracy theories and said she could not understand claims that he had killed his children. She described Patrick as loving toward Lindsay and their three children, as well as a selfless and supportive partner. Their appearance came a few weeks after the trial ended in a hung jury and mistrial on September 4, 2026. The next important date in the case is September 29, 2026, when more may become known about whether the case will be retried. District Attorney Timothy Cruz has the discretion to move forward with another trial, pursue a negotiated resolution, or decide not to retry the case.
The Lindsay Clancy jurors faced an extraordinary burden during a highly publicized Massachusetts trial that ended in a hung jury and mistrial. In Boston Barrister EP53, Attorney Kevin Seaver reflects on the evidence they reviewed, the emotional weight of their service, and the difficult questions raised by the possibility of a second trial.

Welcome back to the Boston Barrister. My name is Kevin Patrick Seaver from Boston, Massachusetts, and I want to recognize the jurors in the Lindsay Clancy trial. The 12 jurors and six alternates heard weeks of testimony, reviewed more than 300 exhibits, and deliberated for more than 38 hours across seven days before the trial ended in a hung jury and mistrial on September 4, 2026. They listened to a graphic 911 call, viewed difficult evidence involving the children, and considered instructions concerning first-degree murder and proof beyond a reasonable doubt. Attorney Seaver asks how the jurors slept, how the trial may have affected them, and how they can recover after returning to their regular lives. He thanks all 12 jurors for their service and explains that the jury system allows a juror to maintain an honestly held position. The widespread publicity surrounding the case also raises questions about whether an impartial jury could be found for another trial. District Attorney Timothy Cruz must now weigh whether to pursue a second trial or whether another resolution is possible. Attorney Seaver also discusses the continuing impact on Patrick Clancy, the extended families, future witnesses, and any new jurors who would again hear the graphic evidence. He questions what another trial would accomplish and whether it would bring justice or extend an already painful process.

The Lindsay Clancy trial raises difficult questions about postpartum mental health care, hospital discharge decisions, and follow-up treatment. In Boston Barrister EP51, Attorney Kevin Seaver examines what the case may reveal about access to mental health services and how patients are supported after leaving inpatient care.

The Lindsay Clancy trial has expanded the conversation about mental health issues and how society balances safety with support. Attorney Seaver asks what access ordinary families have if an educated nurse with access to highly regarded hospitals could not get the help she needed. He questions whether clinicians missed something and whether the mental health system failed Lindsay. He asks how new mothers can be screened and supported without automatically separating babies from their parents. He also questions whether five days in the hospital was long enough and who should decide when a patient leaves—the treating doctor or the insurance company. After discharge, he says, some patients manage their own medication and may stop taking it when they begin to feel better. That raises further questions about outpatient monitoring and how patients can be helped to take medication consistently. Attorney Seaver says he is not a mental health clinician, but he has worked with thousands of clients facing mental health problems since 1991. He emphasizes that it is okay not to be okay and that many people function properly while living with mental health issues. He concludes that the issue must be addressed with courtesy, kindness, and politeness instead of treating people as if they are the boogeyman.
What should you do when DCF first contacts you in Massachusetts? In Boston Barrister EP48, Attorney Kevin Seaver explains why parents should listen carefully, learn the allegations, avoid guessing, and prepare a clear strategy before responding.

Welcome back to the Boston Barrister. My name is Kevin Patrick Seaver from Boston, Massachusetts, and today’s topic is Lindsay Clancy and whether a juror should have been removed from the trial. After seven days and approximately 37 to 38 hours of deliberation, the jury foreman sent the judge a note stating that one juror continued to hold out. Massachusetts law requires all 12 jurors to agree on a criminal verdict. Concerns were raised that the holdout juror was not following the law, the jury instructions, or the beyond-a-reasonable-doubt standard. Defense attorney Kevin Reddington asked to appeal to a single justice of the Supreme Judicial Court so the juror could be removed, but the request was denied. Juror deliberations are confidential, and a juror is rarely removed unless there is dishonesty or improper conduct, neither of which appeared to be present here. After the jury repeatedly reported an impasse, Judge William S. Sullivan thanked the jurors, declared a mistrial, and released them. Lindsay Clancy returned to Tewksbury Hospital, where she has been held without bail. Plymouth County District Attorney Timothy Cruz must now decide what happens next in the case.
The Lindsay Clancy civil case raises questions about testimony, mental health, and Massachusetts DCF scrutiny. In this Boston Barrister video, Attorney Kevin Seaver discusses the difference between criminal and civil proceedings, postpartum mental-health concerns, and why every potential risk involving a baby must be reviewed individually.

Welcome back to the Boston Barrister. My name is Kevin Patrick Seaver, and I’m located in Boston, Massachusetts. The difference between the criminal and civil cases is that, in the criminal case, Lindsay Clancy has a Fifth Amendment right against self-incrimination. She does not have to testify in the criminal case, but Attorney Seaver says she will have to testify in the civil case. He believes that testimony will be riveting, as he expects testimony in the Karen Read civil trials will be. Attorney Seaver believes the mental-health system has been scrutinized because of the Lindsay Clancy trial. He also discusses increased scrutiny of mothers after childbirth for signs of postpartum depression or psychosis, including possible involvement by the Massachusetts Department of Children and Families. He explains that every DCF case is separate and distinct, and each situation must be reviewed carefully to determine whether there is a risk to the baby. Attorney Seaver says District Attorney Timothy Cruz must consider what justice requires and whether another trial is the right course. The next hearing is scheduled for September 29, 2026, and Kevin Reddington has stated that he will seek another trial.
