Citizens United: Chief Justice Roberts’ Concurring Opinion

This text comes from a concurring opinion written by Chief Justice Roberts in the Supreme Court case Citizens United v. Federal Election Commission. In this concurring opinion, Justice Roberts argues that the Court should overrule its previous decision in Austin v. Michigan Chamber of Commerce which held that corporate political speech can be limited to prevent corruption and ensure equality in the political process. He argues that the Court's precedent in Austin is inconsistent with the First Amendment and with other landmark free speech cases like Buckley v. Valeo. Roberts concludes that overruling Austin is necessary to preserve the principle of free speech and the proper role of the judiciary.
