This week on Clear and Convincing, Lisa O' Brien and Michael Carnahan will examine the criminal justice system and process, which are made up of a system of agencies and processes adopted to control crime and penalize those who break the law. While not all cases follow the same path, Lisa and Michael will discuss the agencies involved in most criminal justice systems and the course of the criminal justice process, beginning with criminal investigation and arrest throughthe trial and verdict. In the even of a guilty verdict, the next steps include sentencing and multiple layers of post-trial review, including direct appeal and post-conviction claims made in state and federal courts. They will discuss the roles of the people involved in the process, including law enforcement, the courts and corrections, outline the stages of the process and clarify phrases such as "burden of proof, "reasonable doubt', and "presumption of innocence."
