‘Unjustified Burdens’: Senate Passes Resolution To Repeal Biden-Era Appliance Rule

  • The Senate passed a joint resolution to repeal a Department of Energy (DOE) appliance standard on Wednesday by a margin of 52-46, further advancing the roll-back of Biden-era green energy regulations on household appliances.
  • Republican Georgia Rep. Andrew Clyde is the lead sponsor of the joint resolution of disapproval H.J. Res. 42, which aims to nullify a rule issued by the DOE on October 9, 2024 under former President Joe Biden which added new efficiency and reporting regulations for appliances such as dishwashers, washing machines and AC units. Sen. Jon Husted forwarded the resolution to the House, where it passed on March 5 on a bipartisan vote.

    Following Massive Surge in First Quarter USA Purchases, Chinese Manufacturing Output Now Drops in Second Quarter

    •  Remember, the Bureau of Economic Analysis (BEA) of the first quarter is a hindsight review. Meaning the information released today was based on activity in January, February and March 2025.U.S. companies surged the purchasing of import goods, mostly from China, by more than 50% in the first quarter. They were/are building inventory. So, what happens in China starting in April?

    • The U.S. has front-loaded the inventory. So, orders to China drop now. It’s a natural outcome.
    • We have purchased goods in advance. So, orders to China drop. As a result, the cargo shipments from China to the USA drop in April, May and June.
    • It’s not that U.S. consumers don’t have the product to purchase; the reality is the product is already here, awaiting purchase.
    •  to retain an oppositional perspective toward Donald Trump, the media narrative will not look back at the 50% surge in first quarter purchases; they will only look at the severe drop in second-quarter orders.
    • With less being ordered, the media will now say the Trump tariffs are hurting consumers, deliveries to ports are substantially less, without ever mentioning the products are already here.
    • On the upside, there will be a massive rebound in Second Quarter GDP as the imports have dropped; meaning there is less to deduct. However, we will not see that statistically until the last Friday in July.

          US Futures Surge On Blowout Tech Earnings, Erasing April’s Losses

          • US equity futures are sharply higher, erasing all of April’s losses on blowout earnings from MSFT and META, and relief over signs the Trump administration is stepping back from its harshest tariff threats. As of 8:00am ET, S&P futures rose 1.2% to 5655, the highest level since before Trump’s Liberation Day announcement and pointing to an eighth consecutive session of gains for the cash index; Nasdaq futures gained 1.7%, as META and MSFT added +6.3% and +7.8%, respectively; most Mag 7 names, NVDA (3.7%) and semis are higher given META’s CapEx increase and MSFT’s reiteration on CapEx guidance. The dollar is higher after the BOJ finally flipped dovish and slashed its growth target pushing USDJPY to 144.5 this morning. It’s light on overnight news as most of Europe is closed today ex-UK along with China; US/Ukraine signed an agreement over the country’s natural resources, UK Manf PMI printed better but remained in contraction, and Trump reiterated that there is a “very good chance” of a deal with China on NewsNation last night.

            New: Trump Tariffs Survive Senate Vote – With an Assist From VP Vance
            •  A resolution aimed at undoing his tariffs failed — but just barely.
            • S.J.Res. 49, a joint resolution terminating “the national emergency declared by President Donald J. Trump on April 2, 2025, which imposed a 10% tariff on most imports to the United States and additional duties on specified trading partners,” introduced by Senator Ron Wyden (D-OR), came up short with a 49-49 tie.
            • With three Republicans voting “yes” (Rand Paul (KY), Susan Collins (ME), and Lisa Murkowski (AK)), and Sheldon Whitehouse (D-RI) and Mitch McConnell (R-KY) not voting, that left the vote at a tie, which, by rule, fails.

              But then came a motion to reconsider, which was met with a motion to table.

              • That vote also resulted in a tie, and Vice President JD Vance was then called on to cast the tie-breaking vote, which he did. The motion to table passed, and that means this resolution won’t come back again.
