Electoral College’s Final Say, Election Fraud, A Senate in Play

THE ELECTORAL COLLEGE'S FINAL SAY
Yesterday, several major media outlets, including the Associated Press and Fox News, declared Biden the winner of the presidential election and Biden began positioning himself as the president-elect. But has Biden actually won this election? Malcolm and Michael explain why, at least at this point, the media's declaration of Biden as winner and Biden's declaration of victory is interesting but have no binding legal authority.
With Wisconsin poised for an electoral recount and other states, the subject of federal suits, the outcome of those has kept President Trump's reelection prospects alive. The ultimate decision will be made on December 14 when 538 electors cast votes for their respective states. Between now and then, however, President Trump's legal challenges will be heard by federal courts and there even exists the possibility of new voting fraud or irregularities being unearthed that could prove consequential. While President Trump is 56 votes short of the 270 necessary to prevail, the gap in at least seven consequential swing states is tight enough that this election remains unsettled.
While the media and Democrats are attempting to discount any and all incidents of voter fraud or other irregularities, Malcolm and Michael detail the thousands of non-residents who allegedly voted in Nevada's all mail-in election, which has been forwarded to the U.S. Department of Justice for criminal investigation. They also explain the peculiar so-called voting "glitches," which just so happened to both err in Biden's favor and only in several battleground states.
U.S. SENATE STILL IN PLAY
It certainly appeared that Republicans were poised to maintain control of the U.S. Senate on election night. Since then, however, Democrat candidates have reportedly closed the gap in several critical races and it now remains an open question whether or not the Republican majority in the Senate will be maintained. It could well come down to two runoff races in Georgia, scheduled for January 5. But what's at stake is much more than mere partisan control, Malcolm and Michael contend. Should Democrats take control of the Senate and should Biden ultimately become the 46th president, Democrats look poised to both expand federal courts, including the Supreme Court, with progressives and to eliminate the 60-vote filibuster rule, which will permit Democrats to pass legislation and confirm high-level political appointees with a mere 51 votes, essentially eradicating Republicans' ability to block Democrat legislation. But the opposite also is true: Should Republicans hold their majority, Biden will prove unable to expand federal courts and the 60-vote filibuster will almost certainly remain, forcing Biden to compromise with Senate Republicans on legislation and judicial nominees.
