This episode is being recorded the day after Harvey Weinstein was finally convicted for some of his crimes and a few days after the last debate where I almost threw my shoe at the tv listening to some of the bullshit being spewn at me regarding non-disclosure agreements in the workplace. But I decided to blast some Beyoncé, shake it off and get my ass back to work. SO...caveat to this episode: WHATEVER I AM ABOUT TO DISCUSS DOES NOT CONSTITUTE LEGAL ADVICE. I WILL NOT BE REFERRING TO SPECIFIC CASES UNLESS THE FACTS AND THE RULINGS AND ANY OTHER INFORMATION IS PUBLIC KNOWLEDGE.
I talked about the use of NDAs, the perception of whistleblowers at large organizations and the practice of silencing employees under duress. The intention of protecting corporate branding versus employees and I disect Mr. Bloomberg’s argument that these are consensual agreements signed by two adult parties that both want to keep the facts to themselves as self-serving at best, and more accurately dishonest and condescending
I broke down the legalese on the creation and proper uses of NDAs and then advanced my own theories on when they should be used and when they should be banned, and I covered some recent good news of organizations working to end the use of NDAs, companies moving in that direction and even Mr. Bloomberg’s white flag wave on the issue.
