"I've got sole custody of my kids.  I can move anywhere I want!"  Not so fast.   in this Episode 18,  Attorney Barry C. Boykin and Attorney Kevin R. Johnson discuss the twists and turns, wrinkles and repercussions, of the tie-breaking, interstate-custody law known as the 'UCCJEA.'

In 49 states, including Illinois, the 'Uniform Child Custody Jurisdiction and Enforcement Act' applies a six-month rule when a custody case, or a divorce involving children begins -- where have the children lived for the past six months?  Usually, any new divorce or custody case MUST be filed in that 'home state,' NOT the state where the parent recently arrived with the children.  Also, if a parent wants to change a custody or parenting-time order, if the other parent is still in the original state, THAT is the state where a 'modification' motion must be filed and heard.

It may seem strange and exotic, but the UCCJEA is REAL, and it can surprise you.
