I love being a mediator. Mediation is another of the methods of alternative dispute resolution or ADR. In mediation, the disputing parties work with a neutral third party, the mediator, to resolve their disputes. The mediator facilitates the resolution of the parties' disputes by supervising the exchange of information and the bargaining process. The mediator helps the parties find common ground and deal with unrealistic expectations. He or she may also offer creative solutions and assist in drafting a final settlement. The role of the mediator is to interpret concerns, relay information between the parties, frame issues, and define the problems. Then get both sides to come to an fair agreement. So that is a definition of what a mediator is and does.
In the years I have been mediating I have almost heard every kind of issue and almost every swear word. I have mediated divorce situations and who was going to get the dog. I have mediated estates and will and who was going to get paid. I have mediated relationships between grandparents and children so they could see their grandchildren. And I have mediated a lot of business issues because that is what I have been doing for quite sometime. I think I have mediated almost every situation. Each mediation has two stories and two people that are saying the same thing but in different ways because of their frustration. In the end, we have a proposal on the table and it is time to write and agreement and get a resolution. That is what mediation is about.
