Following the popularity of the term "ELLU P" which was birthed during the just concluded presidential election, it raises questions on the rights of an unregistered trademark owner who stands the risk of his mark being misused for commercial purposes, straying from its function as a trademark, losing its distinctiveness and Losing a trademark before (registration) you even begin using it for commercial purpose.
In episode 94 of the IPSERIES podcast, I discuss the implication of a trademark becoming generic, the defense to a trademark infringement suit, intellectual property considerations for creatives who want to do merchandise, and the possibility of it becoming generic from being overused, among other things.
