Grounds for Invalidating/Cancelling a Trademark: Lessons from Shakira v Shakara case

Listen Later

Did you know Shakira's partial recently won a case at the UKIPO over the name "Shakara" meaning at the moment in the UK you can't use the word "Shakara in Class 25 because Steve Uzoma Nwankpa surrendered it to her this year? Anyways in episode 69 of #IPSERIES podcast, my commentary about the case and what the grounds for invalidating/cancelling a trademark is discussed.
In your opinion do you think the word "My Shakara" which was owned and used by a Nigerian Steve Uzoma Nwankpa before he surrendered it to Shakira was the right thing?
How about the registry directing the word can't be owed by anyone especially when it's been considered to be a common word in Nigeria.
Abi our #Shakara know reach Intellectual Property?
Is the sign "Shakira" owned by Colombian singer and songwriter Shakira Isabel Mebarak similar or identical to Steve Uzoma Nenkpa's "MyShakara" since they both registered in Class 25 for clothing, footwear and headwear for human beings?
