Employers are increasingly challenged when it comes to complying with federal, state and local marijuana laws and managing employee use. On the one hand, medical marijuana is legal in over 30 states and recreational marijuana use (within specific parameters) is now legal in over 10 states including the District of Columbia. An employer must determine and understand what law applies to its workplace, decide whether to drug test, and finally should update the employee handbook to reflect these decisions.
