Assessment of insight can play a significant role in determining whether psychiatric detention is extended or whether a detained patient is ready to be discharged into the community. In other words, the presence or absence of insight plays a significant role as a determinant of the human rights enjoyed by patients living with serious psychiatric (or ‘psycho-social’) disorders. Wayne and Polana review techniques that have been developed for the measurement of insight (aka ‘insight scales’), report on an EAP observational study of clinical discourse at locked psychiatric wards, and consider whether and how evidence about impaired insight should play a role in legal proceedings that determine a person’s human rights.
