Johannesburg-The Constitutional Court has overturned the order of the Electoral Court that found that former President, Jacob Zuma's sentence and conviction was not a sentence and conviction as envisaged in Section 47(1)(e). The apex court has found that the former President is diasqualified from standing for public office until five years has lapsed after completion of Zuma's sentence. The IEC sought the intervention of the apex court for clarity and the correct interpretation of Section 47(1)(e) of the Constitution. This after the Electoral Court found that the sentence and conviction imposed on the former President is not a sentence and conviction envisaged by the Section. The Section declares as ineligible any person that was convicted of an offence and sentenced to more than 12-months of imprisonment without the option of a fine.
