Estate Planning, Guardianship, and Business Succession in Minority Communities

• The minority community is less likely to make comprehensive estate plans.
• For baby boomers, there’s a hesitation to even have the conversation. Their children are asking for it, but the parents won’t engage. It’s important to explore what’s causing the resistance — sometimes it’s a lack of trust, other times it's fear of death.
• Many in the community simply don’t see the value in planning. But at some point, you have to ask: What am I leaving behind? Or… Do I want the state to decide for me?
• It’s important to have minority representation across the board — because trust in the process starts there.

Business Succession Planning

Business succession clients are typically small to mid-sized businesses. Important questions to consider:

• What does retirement look like for you?
• When do you plan to retire?
• Will you sell your business, transition it, or close it down?

If you don’t plan for the unseen, you're not only failing your business — you may also be failing your clients and your future retirement.

And when a business shuts down without a plan, you're unlikely to receive the full value from it.

If your goal is for your children to take over, get them involved early. Let them start with small tasks to see if they share your passion for the work.

The Role of an Attorney

An attorney’s job is to protect everyone’s rights — and to educate clients on how the law applies.

When it comes to guardianships, the right person is someone willing to rise to the occasion and serve. Many family members are reluctant to take on the role, and that’s okay. A good attorney will start the conversation with:

“I’m not here to judge. I’m here to protect the person who needs to be protected.”

But the best way to avoid guardianship altogether?

➡️ Set up a Healthcare Power of Attorney and a Durable Power of Attorney.

Without them, the court may appoint someone your loved one would never have chosen.

• Estate planning affects children more than we often realize.
• If something were to happen to you, who would care for your kids in the short term?
• Estate planning is really about this question:
• How are we protecting our children from themselves?
• Creditors can access these assets — so choose someone who aligns with your values and vision for your children’s future.
• A guardian becomes a pseudo-parent. And it’s critical to understand:
• Custody and guardianship are not the same.
