Is Sexual Assault a Summary Offence or is it Indictable?

Sexual offences under the Victorian law refer to a number of illegal acts that entail sexual activity or behaviour by an individual without the other person’s consent.


The Crimes Act 1958 (Vic) defines Summary Offence in detail. They include rape, sexual assault, indecent assault, and acts of indecency. For rape to occur, it means sex penetrating without consent by forcefully having sex with a lady or man. Sexual assaults take place when someone consciously touches another person against one’s will or compels them to participate or subdue in a sexual encounter without their consent.


The definition of consent is key in these cases, and Victorian law defines that consent given must be free and must come from capable individuals as at the time of giving consent
