          •   a federal judge struck down New Jersey’s ban on the AR-15 rifle but left in place the ban on magazines with greater than a ten-round capacity. U.S. District Judge Peter Sheridan issued the ruling.

            • New Jersey’s ban on the AR-15 rifle is unconstitutional, but the state’s cap on magazines over 10 rounds passes constitutional muster, a federal judge said Tuesday.

             This is a qualified win for Second Amendment advocates and, arguably, for the state of New Jersey. While the decision once more acknowledges the Bruen decision, it also side-steps the magazine capacity issue.

            • This decision will be appealed, and almost certainly by both sides. The magazine ban issue, which rankles (rightly) the pro-Second Amendment side will be challenged, while New Jersey will certainly appeal the decision on the AR-15.                                               • During the trial the DNC asserted that the primary election belongs to the people who control the party, not the voters. DNC lawyers argued that the Democratic Party doesn’t owe anyone a fair process and that it has every right to disregard its own rules or interpret its rules how it wants because it is a private organisation. The procedures for the party nomination are set by the state party, which has leeway to change its rules at any time. In the weeks before the convention, the DNC’s Rules and Bylaws Committee could vote to implement new rules addressing what happens if a leading nominee withdraws before the convention.
                                              • The attached screenshot is the argument from DNC Attorney in the case where they saw they can pick the candidate in smoke filled back rooms if they so choose.
                                              • So effectively this means the primaries are nothing but a charade. It also means the DNC write their own rules and can change the presumptive nominee even after the convention. If a Democratic nominee withdraws after the convention, the party rules are clearer. If the nominee resigns, dies or is otherwise unable to run for president, the DNC — conferring with Democratic leadership in Congress and the Democratic Governors Association — fills the vacancy.
                                              • The DNC adopted the “good conscience” language in 1982 after multiple rounds of reforms to its presidential nomination process. According to the DNC rules, the delegates are bound by their “good conscience” to reflect the sentiments of those who elected them. So, in theory, if the delegates decided to have a change of heart after the convention, they could technically choose a different nominee. As you will see by the screenshot below, Trump is very aware that this will happen. “Given the continued political chaos surrounding Crooked Joe Biden and the Democrat Party, general election debate details cannot be finalized until Democrats formally decide on their nominee,” Trump campaign spokesman Steven Cheung said. “It would be inappropriate to schedule things with Harris because Democrats very well could still change their minds.” I am very sure that at some stage before the November election, Kamala Harris (the presumptive nominee) will be replaced and the real Dem Nom will parachute in at the last minute.
