Following up on Steve Parker’s piece about Post Traumatic Stress Disorder earlier in the day, we decided to do a show about the legal aspects (including risks) of helping a disabled person with legal, financial, or personal affairs. We paid particular attention to issues that a person considering “help” from someone else needed to watch out for: disadvantages of “joint accounts,” the myths and mysteries of Powers of Attorney, hidden costs of trusts, etc. We followed up with a brief discussion of First Amendment rights: free speech vs. “true threats.” One is protected by the Constitution of the U.S.; the other will land you in jail (and maybe get you sued in addition).
