Law Talk : A Modern-Day Paul Revere (11/3/18)

Law Talk featured several different topics, suggested by recent court decisions. First, we talked about a case where a landlord was held NOT liable for dog bite injuries sustained by her tenant’s dog, and pointed out another way to pursue her (and her insurance policy) with a better result. Next, we explained to listeners the use (and misuse) of a device at court called a Capias. It’s an order from a Judge which commands a police officer to arrest a person and present them physically to the Court at its next session to answer for violation of court orders. We also talked about the (il)legality of police seizing the cell phone of someone who was taking video of the police with it, and the predicament that awaited a modern-day Paul Revere. Instead of a midnight ride warning that the British were coming, he simply held up big signs at road side which said “Cops Ahead” so drivers wouldn’t get caught using cell phones while driving. The criminal charges against him were dropped and the Federal Civil Rights lawsuit against the police has just been filed. Listener calls involved a town’s failure to provide timely information and the Freedom of Information Act, and issues about small claims court.
