On this episode, we did one of our infrequent dives into criminal law. Had a couple of great guests: the defense lawyer was Atty. Patrick Tomasiewicz of the Hartford firm of Fazzano and Tomasiewicz. Representing the prosecution was Atty. Michael Gailor, who is currently the State’s Attorney for the Middlesex Judicial District (essentially, Middlesex County). Mike directs the office in charge of investigating and prosecuting all criminal activity in that Judicial District. Lively discussion. Topics we discussed included (what else?) problems anticipated with the possible legalization of recreational marijuana usage; areas to be strengthened in the Juvenile Court area (16-year old career felons, etc.), Drug Recognition Experts, prosecutorial discretion to try a case of not, and plea bargaining. Listener calls included questions about the effect of legalizing recreational marijuana upon those already in prison for violating those laws, questions about obtaining a legal pardon for previous convictions, and the plight of teenage unwed mothers (who, according to the caller, are in many ways still children themselves).
