"Metroplex Adventist Hospital and its parent company, Adventist Health System, were also included in the lawsuit for failing to address his complaints and fostering a hostile work environment. In response to the lawsuits, the defendants requested dismissal on the grounds that Drew's claims were a health care liability claim, not a criminal act, and therefore required expert medical reports. A county trial court initially granted this dismissal. However, In May of 2011, the Texas Court of Appeals for the Third District reversed this decision."
