Strict adherence to rules at the expense of the well being of your brother isn't the way of the Spirit. God is rich in mercy and didn't deal with us according to our sins. We must extend the same mercy to others. Mercy doesn't judge. Mercy doesn't condemn. Mercy seeks the well being of your brother.
