Our panel takes a closer look at Section 3 of the 14th Amendment and the specific language of that section in the context of he case decided in the State Court of New Mexico a day or two ago disqualifying a GOP official in New Mexico from holding office because of his participation in the insurrection.
Will this precedent stick on appeal. Will it stick in the federal courts, the federal courts of appeals and the Supreme Court. By its language, this section could block Trump from running in 2024, but there will have to be clarifications and interpretations dealing with whether conviction of a crime is necessary to bar an official from holding office, and what crimes and their connection with the events of January 6th will suffice.
