Joe Fantini joins us with the latest updates and insights for another episode of Tort Talk Thursday! This week, Joe shares details regarding:
🟡 Talc Update: J&J settled a recent meso case that started in Dallas while working to gather support from 75% of claimants for bankruptcy; Plaintiffs filed a motion for preliminary injunction to prevent J&J from filing bankruptcy outside of NJ in a different bankruptcy court
🟡 Camp Lejeune: Upcoming deadline of August 10th to file administrative claim; with nearly 230,000 claims filed to date we are expecting another 10,000 in the next month and a total of 1,800 lawsuits filed; only 72 cases identified for Elective Option with 31 settlements accepted; this means cases will need to be resolved via trial and an order for selection of first bellwether trial for Tier 1 cases entered this week – plaintiffs will select 3 plaintiffs for 5 injuries and government select 2 plaintiffs for each for a total of 25 cases. Then, 45 days to complete fact discovery
🟡 RoundUp: motion to consolidate and form a multi-county litigation in NJ was denied; over 50,000 cases are pending with majority in Missouri state court; trials scheduled to kick off in Philly and CA state courts this summer
🟡 Recommendations from Joe & Susan for legal conferences to attend this year
