OpenAI Sued: Deleted Chats Retained Due to Court Order

According to VentureBeat, OpenAI is facing user criticism for not deleting temporary or deleted ChatGPT chats despite offering these options, due to a federal court order stemming from The New York Times copyright lawsuit. OpenAI has confirmed it's preserving these chats since mid-May 2025 but didn't disclose it to users until June 5th, although Enterprise and Edu users, and those with zero data retention agreements, are exempt. OpenAI's CEO, Sam Altman, has proposed the concept of "AI privilege" to ensure confidentiality in conversations with AI, likening it to doctor-patient privilege. The company is appealing the court order, arguing it is overly broad and unnecessary. This situation highlights growing concerns about AI privacy and data rights, forcing a reassessment of how data from interactions with AI models is handled and governed, especially for enterprise users.
