Quickie - Twitter & The Right to Free Speech

Listen Later

Today we answer a question that confuses a lot of people: Does twitter violate your first amendment right to free speech if they censor your tweet, suspend you or ban you because of your tweet?
If you want to know the answer, you’ll have to listen to this quickie episode.

Anyone who knows me knows that I am a fierce defender of free speech and the first amendment and I will argue with just about anyone who wants to engage with me on the topic. So this episode is a brief explanation of free speech and how it applies specifically in the context of social media apps like twitter.

This week, Elon Musk purchased a 9.2% stake in twitter and it sent people on twitter from both sides of the party line into a tizzy.  As you may know, Elon holds himself out to be a proponent of free speech and has often expressed his concerns that Twitter censors and regulates too much of the user’s content.  His purchase was celebrated by the right, and condemned by the left, and as you can imagine there were a whole lot of arguments about this. I  saw a lot of opinions on free speech this week that were just straight up wrong and when I polled my own followers I realized that the first amendment and the protections it gives us are confused by a lot of people.  So thats why we’re here- hopefully this super quickie episode can clear that up for anyone who isn’t exactly sure if they know how it works.  And listen, if this is confusing to you - don’t you worry because its not all common sense and by the end of this episode I promise you’ll get it.

Next episode we’re doing a much deeper dive into the First Amendment protections of free speech and specifically we’re going to discuss the overused and (more often than not) misused phrase of “YOU CANT JUST YELL FIRE IN A CROWDED THEATRE”.  So if you’re interested in learning if you can or cannot yell fire in crowded theatre, come back for the next episode too!

If anyone is still confused or has more questions or just wants to argue with me about the first amendment, I am here for that so feel free to reach out!
