In this Conveyancing Matters chat, Lorraine and Stu discuss a County Court case reported by the Law Society’s Gazette in which a conveyancing firm avoided a negligence claim because their terms and conditions did not extend to advising the client about road development schemes in the locality.

The case does not set a precedent – but it is interesting as it shows how important it is for conveyancing firms to have well drafted T&Cs setting out what a firm will do for a client in a conveyancing transaction.

Lorraine and Stu discuss some of the learning points from the case for conveyancers including the importance of understanding what searches are for and how and when to apply for some of the more unusual searches.

They also talk about the importance of having a good search provider!
