This Episode we dive into a complex legal dispute between two New York personal injury law firms, Ginarte Gallardo Gonzalez & Winograd, LLP and William Schwitzer & Associates, P.C. The allegations are that William Schwitzer engaged in client poaching from Joseph Ginarte by offering clients a "briefcase full of cash," specifically $2,000 or $3,000, and free Uber rides to switch attorneys. While Schwitzer's firm characterized these allegations as "baseless" and motivated by "professional jealously," later documents confirm the existence of a Settlement Agreement and General Release dated January 17, 2023, which resolved the underlying action. However, a letter from Ginarte's counsel, dated August 26, 2025, notifies the court that the Schwitzer parties have defaulted on the agreement by failing to pay $150,000 of the $625,000 owed to the Ginarte Firm from the settlement of a related case, thus requesting the court revive and reopen the original action. 

Finally, affidavits from individuals like Mignolia Pena denying involvement in the poaching scheme, and an affidavit from Wilmer Oswaldo Uguna Collaguazo closing his case with Schwitzer's firm, provide glimpses into the claims and client interactions relevant to the litigation.
