The parties get divorced. There's a custody order regarding who gets custody on certain days. A parent gets a child during summer. The other parent does not comply. The co-parent does not return the child. The co-parent is defiant. What do you do? What are you supposed to do? It's the end of summer. The child needs to be enrolled. There are back-to-school things to do. There's a medical check-up for athletics clearances. You have to document this situation, this emergency. You have to show the court what the custody order is. What evidence do you have the co-parent is not going to comply or has not complied? Why do you need the court to intervene? With all that information, have your lawyer file a motion. A motion for emergency consideration for the immediate return of the child. You have to serve the other parent presuming you know where the other parent is. The court will give very little time for the other parent to respond. The court already gave a custody order. You can expect the court to order the return of the child. The court will cite the other parent for contempt and order sanctions. The court does not want this situation to come up every summer vacation. The court is trying to stop litigation. A party defying a court order increases litigation. Have your attorney file a motion for the return of the child.
