There's a situational factor associated with alimony. An example is an ex-spouse who is in jail. Can you get alimony? Alimony from who? Your ex-spouse is in jail. The ex-spouse is in jail. There is no income. The quick answer is no. You're not getting alimony because there's no income. That's the quick answer. There's also the slow answer. Sometimes there are situations where incarceration does not stop income. You might still get alimony. An example is a spouse who has family wealth. Your ex-spouse is living off that family wealth. A trust-fund child. Your ex-spouse has supported you with that passive income. Your ex-spouse was unlucky. Took to drugs. Ends up in jail. The incarceration has not stopped the income. It means you might still get your alimony. There might be restrictions or limitations. There might be some red tape but incarceration will not necessarily rule you out of alimony.
