You want an increase in alimony. In most judgments, the court says that the alimony is in X dollars until further order of the court. The court often leaves the order open. The person can always come back and say the circumstances have changed. The compelling change of circumstances for that person allows an increase in alimony. The court conducts a hearing to find out the degree of change. Determine if such a change is substantial enough to warrant modification. The court then enters an appropriate order. What will you do if your motion is denied? You need to understand why it was denied. If it was denied for some procedural reason, it may still be cured. If the court has denied your motion based on the guidelines and factors, you may not get reconsideration. You can do a motion for reconsideration only if you submit a new factor. Or new evidence not known at the time. It will become a simple filing and then a ruling. Should you go to the Court of Appeals? You can always talk to your lawyer. Your lawyer is going to explain if it is worth your resources to pursue an appeal.
