If you're doing things the way you're supposed to during a divorce, you have a responsibility to disclose all the marital assets. The parties are going to litigate ownership over those assets. What if the spouses are separated? Separated for a long time now. You never got divorced. Now finally you're getting a divorce. Are spouses obligated to disclose those assets acquired after the separation? The short answer is yes. Until you're divorced, you are married. It's kind of binary. You're married or you're divorced? If you're not divorced, then you're married. Being separated is not really meaningful in the context of your marital assets. You have been separated. Each with your own separate life. Are you still obligated to disclose assets after the separation? Probably not but you don't want to be caught failing to disclose. Both sides need to disclose. The court will most likely pick a point during the separation. It can start its determination from that cut-off point. If you fail to disclose you will lose credibility with the court. The court will start wondering what else you have not disclosed. Your lawyers can always agree on that cut-off.
