If somebody is not honoring the judgment of divorce, they are doing several things. One, they are prolonging the litigation which should have been over with the judgment. Two, they are disregarding a court order. It's how the judge will see it. A judgment is like a contract. Failure to comply is a breach of that contract. The other party will have to file a motion. The other party will now pay a lawyer to do the motion. There will be a hearing. The court will act on the motion to enforce the judgment. The judge is going to penalize the party who ignored the judgment. Make that party pay what is due to the other party. Add the cost of attorney fees and fees for the filing of the motion. It is not fair to let the other party carry the cost of enforcing a judgment.
