What if you file for divorce and your spouse does not respond? The law gives a spouse served within the state of Michigan a certain amount of time to answer. Your spouse has 21 days. You can wait out that time. After 21 days, you should take action. If your spouse does not respond and you're not doing anything, the court will dismiss the case due to no progress. If you proceed, you need to file an entry of default. The court clerk will make that entry of default. Contact an attorney because you still need to draft your judgment of divorce. Your attorney will reach out to your spouse. There should be an effort to try in spite of the lack of response. Your spouse did not get service. Your spouse doesn't know how to proceed even if they did receive the papers. There is a certain procedural requirement for a judgment of divorce by default. You have to do it right. You don't want to be in a situation where your spouse can set aside the default later. You want to bring finality to the divorce. You want to make sure the default is properly entered.
