In the context of custody, there are two types. The physical custody and the legal custody. Physical custody has to do with where the child sleeps at night. Legal custody has to do with the major decision-making regarding the child. It does not mean the choice of what to wear in school. It is about medical decisions. It is about educational decisions. Religious decision. Legal custody is about the fundamentals. One of the fundamentals is about schooling. It has become very fundamental during COVID. It showed that an average 8-hour can be compressed in an hour of homeschooling. Now parents have to make a decision if children should be homeschooled or not. The parties will have to talk about it. If only one parent has legal custody, there won't be a discussion about it. In a joint legal custody, the court will have to do an evidentiary hearing. The court will have to find out what is in the best interest of the child.
