There are certain things the court considers when determining the custody of a child. In most cases, it's a very close call. You usually have two nice folks who are well-adjusted. They are reasonable members of society. May be they have decent jobs. The wealth of the parents is not a factor. It is hard to choose between one and the other. The court always has an option to award joint custody. The court can do that. Different judges look at it different ways. There are considerations that jump right off the page. Like abuse. All things being equal and one has a history of abuse. The choice will never be in favor of the abuser. It is the same for a parent with a history of substance abuse. You'll expose the child to a substance like cocaine. Another consideration is how the parent relate to the court. Does one party consistently disregard the court? People go to this divorce proceeding so nasty with each other. They disregard whatever the court says. Then they go to the same judge to appeal for custody. There's a likelihood that whatever order is given will be violated too.
