I want to terminate the father's rights. Do I need a lawyer? The fact that they even ask the question means they don't have to ask the second question. I'm going to do something to terminate the other person's rights, can I do it by myself? You need a lawyer. Your lawyer will know. The lawyer will tell them. You can file a motion to modify parenting time. You can even file a motion to temporarily suspend it. You cannot terminate their rights. You can't do that. It is customarily done through the Department of Social Services. They can file petitions based on abuse and neglect. There might be a hearing for termination. As a competing parent trying to jockey for position, you're not going to be able to terminate anybody's rights. Expectations will have to be put in check. Lawyers help people understand what their true rights are. What they can and cannot do. What they should expect from the court. It's going to be a complicated process. The court is reluctant to change the rights of the parent vis-a-vis the child unless there's something dangerous to the child. You saying bad about another parent does not mean the court is going to change the parenting time. The court is aware that people jockeying for position in a custody case might have uncharitable things to say to about each other. It won't sway the court. The court is going to look at what is in the best interest of the child. If it bears a security risk to the health and safety of the child, the court will react. It is something the court can be behind.
