Can a Parent Lose Parental Rights Due to Absence

The court frequently grants parenting time. The court also faces petitions to limit parenting time, suspend,  or modify it.  Is the absence of one parent a reason to revoke parental rights? Sometimes it is. Sometimes it isn't. It depends on the situation. Mom has not been around the child's life for 18 months. Haven't seen her. Haven't talked to her. You want to file a petition to suspend her rights. What for? Don't kick a sleeping dog. At the moment she's not showing up. There's nothing going on. For all you know, she isn't going to show up. Leave it to lie. The filing and serving of that petition may very well cause her to come to court. Now she wants parenting time. If you're at risk for an absentee father to just show up one day and demand his parenting time. There's no court order that says he can't. There are certain things you have to do. You have to contact your lawyer. Your lawyer should file a petition. He is not going to be able to terminate your ex-spouse's rights absent of some showing of abuse or neglect. The agencies usually take care of that. The motion will suspend the parenting time until the ex-spouse is ready to take appropriate action.
