Can your ex-spouse leave your child with the significant other? Two people get divorced. Sometimes the children are with dad. Sometimes the children are with mom. Both Mom and Dad are in relationships. Mom works out of town a lot. On her week of parenting time, she's out of town. Can Mom leave the children with her significant other? More importantly, does Dad have the right to complain about that? Some relationships because of their nature are governed by the letter of the law of your judgment of divorce or custody order. They may well speak to whether this is permitted. If so look at the court order. Does the court order speak of it? If it doesn't? Is there a first right of refusal? If one parent is not available the other parent has the option of picking up the children. The court understands that parents both have jobs. That someone is pitching in to watch the children. If you're objecting to a spouse leaving your children to a significant other, you better have a compelling reason. The arrangement can work both ways. Your ex-spouse can use the same reason to object to you leaving the children to your significant other. The best way to do this is to have a sit-down and talk about how to deal with this arrangement. Get the complaint in the open. Maybe you can tweak it. If not, someone is filing a motion.
