Every now and then we get clients who would say their divorce is complete and the other side is going to appeal. They're worried about the appeal. You can't successfully appeal something just because you don't like the decision. You can appeal certain areas of law. The court may have admitted certain evidence when it should not. Or, when the court refuses to consider evidence that was relevant to the case. There are strict requirements regarding what is appealable. Issues have to be preserved. The Court of Appeals is not going to give you a new trial and make a decision over there. They're going to review the existing record. You're going to raise issues that were not raised in the lower court. The Court of Appeals is not going to accommodate issues not raised before. They only appeal things that already happened. If the issue were never raised they are not in a position to appeal it. They can't say a judge did something wrong about an issue. An issue that was never actually presented before the lower court. They're not going to do that. The Court of Appeals can deny an appeal. Which is to say they affirm the lower court's decision. They could find that they disagree with the court's finding. They are still affirming the decision. They might have done it differently if they were the jurists. It doesn't mean it has met the threshold for reversal on appeal. The other option is they can find the court committed an error. They can reverse and remand for further proceedings. The case will most likely be remanded to the same judge.
