Why a person or a party to a case appeals. There's always someone who walks away feeling a winner. There's someone walking away feeling the loser. If you don't like the results, do you have a chance to appeal? There's the Michigan Court of Appeals. The appellate court is there for you. You can avail of an appeal if there are reasons for it. An appeal in the appellate court is not like an appeal made by a Friend of the Court to a judge. You can go to a Friend of the Court for a hearing. If you don't like the result, you can ask after a certain number of days for another chance. The court will schedule what we call a De Novo review. The Court of Appeals doesn't do that. It is not a De Novo tribunal hearing cases all over again and coming up with a new ruling. What the Court of Appeal does is it lets you appeal certain areas of law that were made by the lower court. Lower court hears a piece of evidence and in your opinion did not handle it properly. Or, the court admitted something you think they shouldn't. Maybe the court refused something that should have been admitted. These are matters of law. These are things you can appeal. What outcome can you expect from appealing these things? The appellate court has different choices. The appellate court can agree with you. The lower court made a mistake but found the mistake a harmless error. The mistake while it existed didn't really change the verdict. The appellate court may not agree with you in part or may agree with you in part. The appellate court can affirm the decision completely meaning you lost your appeal.
