When should we sell the marital home when you're getting divorced? If the parties have already divorced, the judgment of divorce says who got the marital home. That person is at liberty to do whatever they want with it. During the divorce, the assets are frozen. You can't move assets. You can't sell assets unless the court signs off on it. You can't sell it on your own. Can you sell the house during the divorce by the agreement of the parties? The court can enter an order determining that the marital home be sold. This can happen if you need to sell the house when the market is strong. It can be that an offer to buy the house may expire if you wait for the divorce to be over. The court will put the money in one of the attorney's trust accounts. The court can hold it until it determines the distribution. The court needs to determine expenses and debts that still need to be resolved. Talk to your lawyer to know more about these matters.
