In Michigan, you cannot remarry until you have been granted a divorce, even if you are separated. A judgment of separation divides up property and other assets, but it does not dissolve the marriage. This means that you are still legally married to your spouse until you get a divorce.

If there are any unresolved issues, such as custody or child support, the divorce process may take longer. In this case, you will need to go to trial and the judge will decide on these issues before granting a divorce. Once you have been granted a divorce, you are free to remarry.
